Manga collector faces jailtime

Now this is fucked up, plain and simply fucked up:

U.S. Manga Obscenity Conviction Roils Comics World
The 39-year-old office worker was charged under the 2003 Protect Act, which outlaws cartoons, drawings, sculptures or paintings depicting minors engaging in sexually explicit conduct, and which lack “serious literary, artistic, political, or scientific value.” Handley’s guilty plea makes him the first to be convicted under that law for possessing cartoon art, without any evidence that he also collected or viewed genuine child pornography. He faces a maximum sentence of 15 years in prison.
Can somebody tell me why computer images, sculptures, drawings or pictures of drawings and sculptures are outlawed under this act?

It does absolutely nothing to protect minors and in fact one could argue that it endangers minors even more because it could lead to taking away an outlet for creeps that enjoy this kind of stuff. It is lines on paper. No actual minors are in any way, shape or form involved in the production of it.

Obscenity laws are a fucking joke.

    I agree. I hate lolicon porn as much as the next normal person, but I feel like comics are just thoughts put down on paper. Can you convict someone for having perverted thoughts? It's like if you convicted someone for having snuff porn for having a drawing of someone getting stabbed with a sword.

  • Well, it's disappointing because he plead guilty. I guess pleading guilty is better than a guilty verdict, but it's still not good. Let's hope that a bad legal precedent is not set just because they went after someone who didn't have the guts to stand up for themselves.
  • Yes. There's a huge difference between fantasizing or liking to read about something and actually DOING it. That law doesn't outlaw cartoon depictions of other illegal activities. I'm not sure why they can draw a distinction.

    That's actually a very good point seeing that a lot of Hollywood movies seem to have crime as the main theme.

    Not to mention movies like Hostile or Saw...

    Pleading guilty was part of a bargain with the plaintiffs.
  • I agree with Emily and Nuri on this one. If it's on paper, it's not hurting anyone, and he's not bothering anyone (hopefully) about it.
  • Now, I'm torn on this issue. I agree that drawn child porn is not hurting anyone directly. I also agree that exposure to such material could make someone act on their impulses. However, I can also see that using lolicon instead of real children may actually decrease the number of child molestations, due to the "release" that these pedophiles get from lolicon. I would need to see some surveys to make a final judgement of it.
  • If it's not real little girls/boys, and no real little girls/boys were used in the making of it, then I personally see no gray area. The purpose of child porn laws are to prevent harm to children, not to punish weirdos who like little girls/boys.

    If you think about it seriously, though, the reason that we have a moral problem with having sex with children is because of their lack of mental faculties, not because of the size and shape of their bodies. We consider it to be rape, even if its consensual, because one of the people involved is not mentally capable of consenting.

    If in the real world some 40 year old person had some rare condition that left them in a 12 year-old body, there would be no moral problem with getting with them. Likewise, if there were some rare condition where they had a 35-year old body, but a 12 year-old mind, there would be a very big problem.

    Regardless, it is true that the guys who like Sasami are pedos who are attracted to 13-year olds, and they just need an excuse to find something to wank at that is not technically wrong.

    Exactly. There was even an episode of Law and Order: SVU about this precise situation a while back. It involved a woman who was at least 18 or so, but had some condition where she looked 12. Her boyfriend was someone who probably would be a pedophile, except (as far as the characters on the show could determine) he didn't act out his impulses against real children and lucked out in finding this legal adult with the body of a child.
