FUNimation sues ADV Films.

Wait, what?

I didn't think it was possible to sue a company that's already liquidated. How does that work?

  • They are suing the companies that ADV sold their assets to, which most of those companies are made up of people who were in charge at ADV when it was around.
  • And lo, the mighty anime industry had fallen,
and the parts resorted to feasting upon themselves.

The way the article is worded makes it seem as if FUNi is suing ADV itself, as if it was still around.

There's a bunch of corporate law that dictates when you can get at people or companies who are related to the old company. Just like a person can inherit debt or contractual liability, so can a company.

Basically, this is the crux of the matter:

"The suit goes on to claim that ADV's transfer of assets "was made with the intent to defer, hinder or defraud the creditors of ADV," including Funimation, and that the new companies "succeeded ADV's contractual liability" in regard to the outstanding debt. "
