No they don't. Without net neutrality legislation, they can use their TOS to allow or deny anything they want for just about any reason. They don't care one whit if you're downloading Linux or Linux pronography: they simply care that you're using more bandwidth than an old lady.

Half true. Some one from Cisco who works on the Comcast account told me that they allot 78KB/s for every user. This supports your claim. However, when the MPAA comes knocking with a list of IP's that have been stealing their shit, it's a hassle as well. Bottom line probably 95% of torrent traffic is trouble for your ISP, hence all the creative and inventive ways they've come up with to stop it. I still say that if you throttle it down to nothing they'll probably leave you alone.
Interesting fact though (again from my guy at Cisco), torrents are no longer the major bandwidth user. The explosion of internet video is now the main user of bandwidth.
