He has a point that YouTube has made money on the videos over the years, that most claims are false, and that reviews are absofuckinglutely fair use. But in simple gameplay videos, which are arguably the majority of videos on YouTube showing in-game content, the content used is absolutely protected under copyright and the copyright owners have the right to control the appearances of their assets.
Now, that being said, I think gameplay videos like those put out by the Game Grumps, where their commentary while playing is, for many people, is more important than the gameplay itself, should be protected.
But what about Let's Plays, which are gameplay footage and commentary (much like what the Game Grumps do)? That can be regarded as new content.
Only the commentary is new content (much like MST3K or Riff Trax) and while I don't think people who make "Let's Play" videos should have to pay licensing fees, I think they need to recognize that they aren't solely entitled to ad revenue from those videos. Unlike reviewers, who are only showing portions of the game as example, Let's Play videos are showing a significant amount if not all of a game. I firmly believe that video game companies are entitled to a percentage of any monetary gains from those videos. Any why not? Those YouTubers are making money off of their content.
