    That's discharge of a firearm. The force simply wasn't directed because it wasn't inside of a gun. Also, they charged him with possession of ammunition because he is a convicted felon. We're not gonna bend over backward to help him out here.

    Yeah, he should not have had the ammo in the first place but I also have a deep philosophical problem with laws being misapplied when there is no law covering what happened. Which is likely what happened.



    If you drive your car into a crowd of people, killing many do you get charged with vehicular manslaughter or using a weapon of mass destruction?

    No, but any device used to fire a bullet a via its explosive charge (i.e., I don't think a blowgun that doesn't attempt to detonate the gunpowder counts), no matter how sketchy, is a firearm. So yeah, a BB gun where the BB is used to detonate the explosive charge in the bullet to fire it is a firearm. So is a hammer/pin/vice gadget. They are crappy, dangerous, improvised firearms, but they're still firearms. If it involves detonation of gunpowder or a similar explosive substance in order to propel a projectile, no matter the method used to detonate the explosive substance, it's a firearm.

  • Really? I wouldn't have thought about it but I'd have thought the order would be plaintiff and defendant.
  • The order is [Person bringing the suit] v. [Person defending], regardless of Plaintiff or Defendant status. In an original civil suit, it is Plaintiff v. Defendant. In an original criminal proceeding, it is [the government represented by the prosecutor] v. Defendant.

    Depending on the rules of the court where you are, the names may switch places if the defendant appeals.

    Looks like I've been handed a big ol' intranet application at work. It's completely uncommented, the developer has turned in his two week notice and is completely tuned out, and his non-coding manager told me "deal with it" even though I have already found things that would break the moment his user account gets frozen.

    Hate to bitch about this kind of stuff, but at this point I feel I'm taking crazy pills.

  • Trying to close on a house is a pain in the ass! I would have been happy closing today, but they had to go and find something wrong with the previous sale. Now both legal teams needs to contact more people before they're ready with the title.

    Still getting the house. I'm just going into production next week and won't have much time to move. :/
  • Something I was very happy to find when selecting a closing attorney is that in my county closing attorneys get a set fee. In the next county they can charge as much as they can bill you for.

    Due to all the crap I had to deal with I made out very well on that end.

    I also wish I could clear Netflix of my boyfriend's watching history. Their recommendations are not for me. Profiles need to come back with a vengeance.

    It saddens me both that bike thievery is so common in cities all over the world, and simultaneously basically not investigated or punished in most of them.

    My bike will be equipped with bluetooth soon. Actually, once I'm done with it, my bike will be too distinct to steal. Also, too damn heavy and slightly broken.

  • Berlin isn't too bad for bike thefts. It's obvious they just saw the shiny new bike and had off with it. Just bad luck, in the end.
  • In Amsterdam, bike vandalism is a bigger problem than theft is. Apparently, people enjoy chucking bikes into the canals, which is bad, not only for the bike owner, but also everyone boating in the canal.

  • Next door are having building work done, as far as we can tell they having walls knocked down. The kicker being they didn't tell us that they would be doing this and its right in the middle of revision time.
